Salam.

My staff already resign on 13 June 2010. Her give one month notice because she already work with this company since 17/10/2005.For your information, last day she work at this company is 30 June 2010 and her have annual leave for 2010 is 18 day (reference : my company handbook, 4 - 5 years  get 18  day). Her salary is RM 2000 per month.

My question is:

1) Her annual leave until June 2010 is : 6/12*18= 9 + 4 =13 days(4 days untake leave 2009.) That is right calculation for her prorate annual leave?

2) Did we need to pay her untake annual leave (13 days) because her give a notice for one month but she just come to the office until 30 June 2010?

3) Did we can just take the 13 day untake annual leave for cover her work day from 1 July 2010 until 13 July 2010 and pay 3 days for her annual leave only?(we work 6 day per week)

If she had applied to take the balance of leave and was approved, the company have to pay up to 13 July.
