calculation of annual leave when resigning

Hi, I have joined the company in 01/06/2007 and tendered my resignation letter dated 31/05/2010. I have 12 days annual leave. So how many days of annual leave i entitled to? If the law says :  "12 days for every 12 months of continuous service if he has been employed by the same employer for a period of 2 years or more but less than 5 years. "
How do i calculate? Is it pro-rated?

You start counting 12 months from 1/6/07 to 31/5/08 = 12 days and so on. Looks like you have exactly 3 years of service.

Thanks for reply..but how do I calculate my annual leave when I resigning...now i received a statement saying that I owe co 4 days on pro-rated basis as I already took 10 days emergency leave taken in March, 2010. Is tat true??

You have worked for 3 years and your annual leave should be 3 x 12 days per year. How many days of annual leave you have taken since you joined the company? Consult the Labour Office if you cannot get the matter settled.

hi guys,

i guess the calculations should be total annual leave you entitle to deduct leave taken previously. But, how if certain company only allow you to carry specific number of days to next following year?

i gusee the calculations should be:

=basic salary / 26 days * annual leave balance.

am i right???
