Drafting of Appointment Letter

Dear Mr Siew,

Good day to you. I would like to seek your advise on the following scenario, if they can be incorporated into an Appointment Letter:-

Company: Automobile workshop

Position: Mechanic or  Admin clerk

Basic Salary: RM1,300

Working hours: 9.00am - 5.00pm (Mon - Sat with one offday during the week day and Sundays until 3.00pm)

Overtime: RM500 from 5pm - 7pm (expected to work OT daily except on offdays & Sundays which ends at 3.00pm)

Questions:-

Does the above conditions infringe the labour law in terms of exceeding the work hours per week?

Can OT be made compulsory and in a fixed amount?

Looking forward to your reply and your views on other points which I may have left out.

That may infringe  Section 60A   of the Employment Act. You may consult the Labour Department also. For others points you can refer to the  Employment Regulations.
