Resignation - Salary and Annual Leave Calculation

Good day to you!

My company staff has submitted his resignation letter on 13/04/10 with 1 month notice. So his last day should be on 12/05/10. His monthly salary is RM3,000 and left 7 days annual leave. Can I use other method of calculation rather than stated in the Employment Act since he is not covered by it. My calculation as below:

May salary = Salary / 21 day (total no. of working day in May) x 8 days (no. of working day)

Annual Leave Pay = Salary / 21 days (total no. of working day in May) x 7 days (annual leave left)

Please advise if I'm wrong, thanks.

I think he should be happy with both your calculations.
