Prolong Illness Leave

An Executive staff has been on medical leave since 16th October 2009 till todate. She has fully utilised all her medical & hospitalisation leave for year 2009 and year 2010.

Recently, her doctor had issued a letter (March 2010) to the Company to put her into into Prolong Illness Leave. As the Executive Handbook does not explicitly state the terms of salary payment during prolong illness, we shall use the Union CA as a guide. It states, 4 months full pay, 4 months half pay & 4 months no pay.

The Management has yet make any decision but can the Company utilise her annual leave after all her medical leaves has exhausted to ensure that she still continue receiving her pay until final decision by the Company is made known.

Since her doctor had already issued a letter, and the staff in covered by the union (i presume, since you plan to use the Union CA), then there is nothing actually that your management needs to decide on.

My opinion is you shouldn't touch her annual leave.
