Short Notice Resignation Rejected by Employer

Hi,

Based on my employment contract i need to give 2 month notice. Im still have 20 days of annual leave. Its mean that still need to work about 1 month. Im request to to resign in a one week notice and willing to pay salary in lieu.

The problem is my employer refuse to let me go in 1 week notice although i pay the salary in lieu and they hold my salary which the amount is more than salary in lieu amount. If i quit the will take an civil action against me.

My question is, can they take action against me?

Well, since they have withheld as you said your earned salary more than the indemnity in lieu of notice, there is no reason for them to take civil action against you, isn't it?

but if they do intend to take action to what extend can they do ? Issue an arrest warrant or something ?

I'm sure it won't be as severe as that. But you can always clarify with the labour department.
