resignation after maternity leave

Is it possible for a woman employee to resign with proper notice immediately after the maternity leave? Currently she is earning 4k monthly and at managerial level. In our company managerial level should give 3 mths notice however it was not stated in her employment letter as when she join the company she was not yet a manager. Now she is giving us 1 month notice only. Can the company withold her maternity allowance? Please advise..

Dear HR,

The lady has just given birth and had a baby to take care of. My advice, whether it is against the Labour Law or your company Law, do exercise some compassion. Many a time, employer or administrative staff has been too stringet about the company policy that it angered some employees. Giving 1 month notice is sufficient enough for you to find a replacement. Even if you had never find one yet, you can always talk things over with her.
