termination notice by employee & employer

Good Day to you,

Would want to ask can a employer stated a termination notice as below:-

After confirmation, employee have to give 2 months notice in writing or 2  months salary in lieu to terminate the service. If the company want to terminate the service of the employee, the company have to give 1 month notice or 1 month salary in lieu.

That is not in accordance with what is stated in Section 12(2) of the Employment Act as quoted below:

12. Notice of termination of contract.

(1) Either party to a contract of service may at any time give to the other party notice of his intention to terminate such contract of service.

(2) The length of such notice shall be the same for both employer and employee and shall be determined by a provision made in writing for such notice in the term of the contract of service, or, in the absence of such provision in writing, shall not be less than:

is mean, termination notice must be same between employee & employer. if 2 months, both also have to give 2 months, it is?
