Short Notice of Resignation

Hi, i just tendered my resignation on 10 september 2009 and i understand that i have to serve one month notice which until 10 october 2009 but i informed HR that i have to start work at my new company on 28 september 2009, so i have given them two weeks short notice of  resignation. Now when they come out a letter for me to pay them back the other two weeks which i short notice, they included weekends because they said the calculation is base on calender day. Can i check whether the thing that they do is the follow the labour law? Please reply soonest possible due to HR gave me 14 days to settle the payment to them.

Well, I think you should be paying (salary/30) x 14 as indemnity for the two week short notice.

Hi, I just tendered my resignation on 21st September 2009 (Hari Raya public holiday). My company is an oversea company doing business for oversea market. Therefore, we are working even during the public holiday.

I am still under probation, hence my period to serve notice is only 2 weeks based on the offer letter. My last day should be 4th Oct 2009. However, the company only pay me till 2nd Oct which is a Friday. Meaning to say that I am not getting paid for the weekends. Is that right?

It is right to get your salary paid up to 2nd Oct if you are working 5 day week. However, Do bargain with your employer for extra "ordinary rate of pay per day x 2" for working on gazetted holiday as per EA60(D).(3)(a)(i).
