Maternity Leave and Hospitalisation

Please help to clarify following scenario:

- Employee is currently 2 months pregnant. She has utilised all her MC's allocated for the year. However due to some complications she has been hospitalised for 3 days and she is on MC for home rest for 3 weeks. Since she has not given birth I am assuming the 60days maternity leave is only applicable once she has given birth.

- Please clarify how do we treat the additional hospitalisation and home rest?

Hi Baljit,

The expected mother is considered commencing her maternity leave earlier provided the commencement date does not exceed 30 days in advance.

"EA 37(1)(bb) Where a female employee abstains from work to commence her maternity leave on a date earlier than the period of thirty days immediately preceding her confinement, such abstention shall not be treated as maternity leave and she shall not be entitled to any maternity allowance in respect of the days during which she abstains from work in excess of the period of thirty days immediately preceding her confinement."
