Notice on resignation

Dear Mr Siew,
I am working with my current company for more than 10 years.
My letter of appointment stated that 1 month's notice is to be given to the employer for resignation.
There was an amended copy of Employee Hand Bank being emailed to all staff last year.
For staff who has worked for 5 years & above, 2 months notice is needed for resignation.
Please advise how many months' notice that I need to give to the company for my resignation.

The revision of the notice period for resignation is in accordance with Employment Act. You need to give 2 months notice:
EA12(2) The length of such notice shall be the same for both employer and employee and shall be determined by a provision made in writing for such notice in the terms of the contract of service, or, in the absence of such provision in writing, shall not be less than --
- (c) eight weeks' notice if he has been so employed for five years or more on such date:

My salary is above RM2k.
Does the "2 months" notice of resignation still applied in accordance with Employment Act ?

Hi Elaineeyl,
Since your salary is above RM1,500, you are generally not under the coverage of Employment Act. Therefore, the employee handbook or letter of appointment shall prevail in your case, where you have to give 2 months notice for resignation as stated in the revised employee handbook. Note that you lose nothing as it is in accordance with Employment Act.
