EMPLOYEE LODGED POLICE REPORT AGAINST EMPLOYER

Hello. I have an inquiry which I hope you could shed some lights into this.

Recently, an employee (Mr X) had been rated 4 in the yearly appraisal. 4 - the lowest appraisal. He had been informed of his appraisal result by his superior and HR Dept. Later, his supervisor, along with other collegues in his department, had discussed about some other official matters, which then led to discussion about the non performing staffs. Mr X, got to know about this and thereafter, he lodged a police report against the company. His police report among other contains allegation against his superior , for not treating private & confidential matter as such. Can we issue a show cause letter to Mr X? Has he breached any labour law rules?

I think the question should be has he breached any company's rules by making police report. Better consult your company legal advisor.

Anyone has the rights to lodge a police report. But such report may not necessarily constitute any detriment to the defendant, as a police report is not a proof of conviction.

In your case, I think the action of the under-performing staff to lodge a police report is not a big issue. He should rather spend his efforts to defend his under-performance in order to salvage his rice bow. Note that to certain extent the brainstorming within a team is healthy and constructive.
