Maternity Allowance

Hi there,

would appreciate if you can guide me how to pay for the maternity allowance.

Employee joined company on 18/05/2004.

Employee terminated due to misconduct on 23/04/07 and the date of termination employee is 5 months pregnant.

Employee has now given birth on 26/07/07.

Her last drawn salary is RM849.00

How do I pay her maternity allowance?

What is the procedure?

Honestly I have not given any advice to employers about payment of maternity allowance when the employee has been before confinement, dismissed on grounds of misconduct. I think it would be better if you consulted the Labour Department whether you were liable to pay in the first place. I would like to think that you are not liable if she was dismissed after proper domestic inquiry had been carried out.

Do give you feedback here after consulting the Labour Department whether you are liable or not.
