Dear Siew,

I am entitle for 12 days anual leave per annum. meaning based on prorated basis, I have 1 day annual leave per month.

in my offer letter, if i were to resign, i need to give my boss 2 months notice.

Let say I tender my resignation on 1.7.09, my last day will be 31.8.09.

on 1.7.09, i have balance leave 5 days. since my last day is falls on Aug, am i still entitle for 1 day pro-rated leave for Aug? meaning, will my balance leave become 6 days? or 5 days?

Without knowing the details, I would suggest you do this. Your prorated leave by 31/8 should be 8 days, right? You minus 8 with the number of days leave taken during the period, the balance is your entitlement.

I joined my company on 25Aug 2003 and have completed my full 5 years on 24Aug 2008. My office says I 'm only entiled to 12 day leave from 25.8.08 to 24.8.2009. The additional 4 days can only be taken after 25 Aug 2009.

Are they right to say this ? If they are wrong how ,do I claim the add. days?

You can calculate like this:

25/8/03 to 24/8/04 = 8 days

25/8/04 to 24/8/05 = 8 days

25/8/05 to 24/8/06 = 12 days

25/8/06 to 24/8/07 = 12 days

25/8/07 to 24/8/08 = 12 days

25/8/08 to 24/8/09 = 16 days (you can take from 25/8/09 onwards)

My questions. . Why can't I take all the 16 days up to 24.8.2009 as you've agreed that I have 16 days of leave. Do you agree that I am entilled to only 12 days for the current period ( 6th year).

It's really confusing; I'm get 16 days but I can only use them in the 7 th year of service. What happens to my leave if if leave the company on 25 .8. 2009 ?

It was really the simplest way to explain to you. By 25/8/09 you will have reached the 7th year when you are entitled to take all 16 days earned in the 6th year. Why must you take before 25th and not on 25th itself, which is in the 7th year?

I'm fully aware that when I'm in my 7th year I can take 16 day leave.

What I don't understand is -- take only 12 days whereas You're entitled to 16 days for the 6th year.

My contract further says " Upon confirmation, you are entitled to 8 days of annual leave for 12 months of continuous service- (for 2 years and below ) in the company. Subsequently will be 12 days ( 2 years to 5 years)

As such , I wasn't able to take any leave for the first 12 months of service. For
