When does maternity leave shall commence?

My wife has delivered our baby on 14-7-09 at 11.15 pm. She has completed her full working hours on that day before the delivery. So when shall her maternity leave commenced? On 14-7-09 or 15-7-09?

Her company insisted that the maternity leave shall start on 14-7-09. What can we do about that?

It should be the actual day your wife gave birth i.e. 14/7. Read the definition of "confinement" as defined under the Employment Act:

"Confinement" means parturition resulting after at least twenty-eight weeks of pregnancy in the issue of a child or children, whether alive or dead, and shall for the purposes of this Act commence and end on the actual day of birth and where two or more children are born at one confinement shall commence and end on the day of the birth of the last born of

Hi KL,

What about her wages on that day 14-7-09 where she has completed her full working hours? Shouldn't there be a replacement of leave for her on that day?

Your baby has chosen to come so late, wrong timing (but congratulations anyway). I could only show you the law. Why not you consult the Labour Department for an official opinion?
