I was working in a MNC as a Senior Manager, and resigned from the company 1 year ago. In order to gain the goodwill and a letter of recommendation from the top management, I had signed a letter agreeing on Employment Contract Clause 8 -- Confidentiality, and Clause 10 -- Non-competition. I wonder how long is the validity period for the abovementioned clauses? As I am considering to join a company which is the direct competitor of the perious one.

Please advise. Thank you.

I can only ask to you to consult a lawyer if you think necessary. For me, I couldn't be bothered about those clauses.

Hi Mr. Siew,

Thanks for your advice. I was told not to bother those clauses too.

But in reality, how strict is the enforcement of such clauses in Malaysia?

You have not come across any High Court judgment concerning such restraint of trade matters. I really don't know.
