I run an internet cafe and of recent we had an incident whereby our clerk was assaulted by a customer on June 1, 2009. The victim had to undergo and operation of which we agreed to pay half of the expenses. During his medical leave period, he requested whether he could be transfered to another cafe for fear that he may be assaulted again. Furthermore, he has a medical problem whereby he is not able to take painkillers of any kind as he is allergic to them. We only came to know of this condition after the assault took place and when he was treated at the hospital.

Since we do not have another cafe, we told him that we would have to let him go as we do want to be responsible if anything should happen to him physically or medically. We terminated him on June 19 and agreed to pay him his full month salary for June even though he worked for only 1 day in June. Have we done the right thing?

I don't think you have been doing the right things all the while. What about SOCSO? Was he not covered with SOCSO? I think you better settle the matter with him to his satisfaction so that he will not make complaint against you. I really don't know how to advise you.
