Probation Staff on Emergency Leave

My new employee who started 23 Mac seems to be absent more often rather at work even though he just join with the same reason every time emergency leave due to family problem, when we ask him to justify he very sorry but got family issue that cannot avoid. We then suggest that he resign and he said ok but we must pay him the notice in the offer letter 2 months otherwise he does not want to go.

If we terminate him for poor performance must we still pay or can we justify this if he complains to labour department.

You should have given him written warnings. If you have not, start giving him written warnings. If there is no improvement in his attendance, then you have no choice but to sack him without notice. Let him complain.
