I started working with a private company on 1st Sept 2003. I'm entering into 6th year of service. I understand that the annual leave for employee working 2 to 5 years of service 12 days of paid annual leave. Whereas more than 5 years of service 16 days of paid annual leave. Am i entitled to 16 days of annual leave this year 2009 or are my 16 days of annual leaves only effective from next year 2010.

Please advice. Thanks

You are entitled to take 16 days after 1 Sept 2009.

Since your date of join is not at the start of year and this year being your completion of 5th years of service, company normally will calculate like this for this year entitlement

01.01.09 to 30.08.09 = 8 days until end of Aug09 & 01.09.09 to 31.12.09 = 5.5 days. As such for yr 2009 yr leave entitlement is 13.5 and you will enjoy the full 16days next year.

Another way of looking at it is:

1-9-03 to 31-8-04 you earned 8 days

1-9-04 to 31-8-05 you earned 8 days

1-9-05 to 31-8-06 you earned 12 days

1-9-06 to 31-8-07 you earned 12 days

1-9-07 to 31-8-08 you earned 12 days

1-9-08 to 31-8-09 you will earn 16 days which you can start taking from 1-9-09 onwards
