Due to peak production and to meet the goods delivery lead time, thus we have request the production workers to carry out overtime after normal working hour.

One of the FW disobey the superior instruction and didn't turn up to work. And he has no reasonable reason to his absent. And we found that the day we asked him to work Overtime, he bring outsider to the hostel area. He is fit to work on the day we called for overtime.

This FW previously with 2 warning letters pertain to his attendance problem. So due to this new recent insubordination, can we issue him final warning letter and to terminate his service. ( Is it upon 3 warning letter the employer can terminate the employee?)

Please advise.
