Dear Sir 

I need advise on the below situation:

Our compang go on yearly contract basis.  The end of the contract will 31st December 2019 brfore the end of the contract we have send the renewal for year 2020 to the manager.  In the content of the contract is the same as 2019 even the 2 month notice of the resignation.  So Feb 2020 the manager hand in the resignation should he fulfil the early contract or just remain back to 1 month notice?

The new contract been send to him since middle of Dec 2019 but the manager never return back the sign copy. So what should we do?

Actually, there is no need to give any notice and the expiry date of the one year contract is know i.e. 31 Dec 2019. If he never come to work this year, you could presumre he did not want to work for the company.

Hye Priscella,

Looking at the facts that the employee only handed over his resignation notice in February 2020, it looks like he already accepted the renewal i.e the new contract in 2020. Thi is also based on the fact that the early contract was expired on 31.12.2019. 

Therefore, he is required to give 2 months notice as you mentioned that the terms/conditions remained the same including the notice period for resignation.
