Hi. I would like to ask on the annual leave.


I joined a company on Nov 2018, received confirmation on May 2019. 12 days annual leave entitled for below 2 years of service, maximum 5 days to be carried forward for next year.

On Dec 2019, I would like to carry 5 days of my AL forward but the HR said I was not entitled the 5 days as I received my confirmation letter on May 2019. And the HR gave me the calculation as below:


Remaining annual leave on 2019
12 days/12 months x (12-5) = 7 days


My question is, is it true that I'm not entitled to have that 5 days?

Annual Leave entitlement is based on duration of continuous services for a particular calendar year.

For example in 2018, you joined in Nov 2018. Therefore your entitlement of Annual Leave for the duration up to 31/12/2018 is (2 months/12 months) X 12 days = 2 days

For the duration from 1/1/2019 to 31/12/2019 your Annual Leave entitlement is (12months/12 months) X 12 days = 12 days. If you have taken any Annual Leave before 31/12/2019, you have to deduct the numbers taken to get your Annual Leave balance as at 31/12/2019. If you have balance of Annual Leave more than 5 days, and your company policy allow to carry forward 5 days, then you can carry forward that 5 days.

Your confirmation date does not contribute anything to the calculation.
