We are plan to hire some help staff continuously, however they will work less than 48 hours a week.

May we release a temporary contract for 6 months without statutory payment and annual leave entitlement? or this will be compulsory?

or they will not sign any document/ contract with us but we pay them per hour whenever they work.

Don't ever do that, the law may catch up with you one day especially when the workers complain the authorities like EPF, SOCSO and the Labour Department one day.

May we offer them as independent contractor?

Lets see whether they are really independent contractors or just another employees.

1. What sort of service or goods they provide you?

2. How are they paid.

3. Do you have control over their working hours or do they have fixed working hours?

4. Where is their place of work or can they come and go as like they like?.

5. Do you have any say how they carry out their work?
