The government has declared 30 July 2019 to be a public holiday to celebrate the installation of Malaysia’s 16th Agong, Al-Sultan Abdullah Ri’ayatuddin Al-Mustafa Billah Shah.Is this compulsory leave?

Since the additional holiday was declared by the Federal government, I think it is compulsory. Give a call to the Labour Department to confirm.

If the holiday is declared under Sec 8 of the Holidays Act 1951, then it will be compulsory to be observed by the employer. (refer Sec 60D(1)(b) of the Employment Act 1955).

However, employer may opt to observe the said public holiday in either -

  1. Declare 30/7/2019 as public holiday to all employees, or
  2. Work as usual on 30/7/2019 but pay the employees based on the public holiday rate of pay for that day, or
  3. Work as usual on 30/7/2019 and declare another date as a public holiday in conjunction with the installation of the YDP Agong.

How if the company is not giving any holiday, double pay or replacement holiday to the staff, is there any penalty for the company?

If that happens, what you can do is to bring the matter up with the Labour Department, let the department deal with it.
