Resigned Within 24 Hours

Hi Admin,

Good day to you.

I would like to get your opinion and clarify some issue below:-

1. One of my contract staff who works for more than 6 months and he claimed that he has tended his resignation letter within 24 hours on 6th July 2019 to the supervisor. However, the supervisor informed HR by stating that this staff did not showing up to work on 7th July, 8th July & 9th July (three consecutive days) without providing the resignation letter. 

As per contract, staff needs to give one month notice for resignation. 

For above issue, should I take it as abscondment or resign within 24 hours and claim one month salary from him as indemnity in lieu of notice?

Kindly advice.

u need to do some due inquiry process first : show cause letter + demand him to come back before you can concluded he is absconded (even we know very high chance is abscondment case cos law did not recognise automatic become abscondment when worker did not turn on for work.)
