Dear Sir / Madam,

May I seek clarification about the entitlement of Annual Leave as stated in the Employment Act:

Take example of: 60E(1)(A) an employee shall be entitled to paid annual leave of eight days of every twelve months of continuous service with the same employer if he has been employed by that employer for a period of less than two years.

The interpretation of the above underlined is that mean, the employee will have the accrued AL after completed the 12 months of service? E.g. an employee joined 12 June 2019, he/she will start earning the AL, however, he/she will only be able to utilize this leave after 12 June 2020? In between 12 June 2019 to 11 June 2020, any leave he/she taking is an unpaid leave?

Yes, that's right, the employee will have to complete 12 months service to qualify for paid annual leave. If he takes leave before the period, it could be unpaid leave unless the company is willing to grant prorated advance paid leave.
