The company decided to terminate a prenancy staff due to organizational restructuring. The department was no longer required.

The staff due date will be on end of June and the Management plan to offer her the 2 months maternity. Also 1 month notice will be given by transferring her to another department to help on some data entry task. But the Management wants to talk to her about the termination before she go on maternity leave, so she got around 3 months to get a new job.

1) is it against the law for above action - terminate staff after returning from maternity leave ?

2) shall we inform her earlier on her termination?

3) can we termiante due to organizational restructuring? any supporting documents needed to prove?

Discuss with her whatever the management intends to do about her case see whether there is any amicable agreement.

Anyway, about termination,  employers have the right to terminate employees' service for whatever reasons and the employees also have the right to lodge complaint at either the Labour Department or the Industrial Relations Department about the termination.
