Resignation with bonded contract

Hi,

I was being bonded by my company for 1 year. And it is stated in my bonding agreement that i need to serve 1 year period with the company, failing so, i have to pay the penalty stated.

Have checked with my HR before tendering my resignation that as long as i serve the period of 1 year including my notice period of 3 months, I will not need to pay for the penalty.

Head of my company wants me to leave 1 month earlier than my notice period of 3 months. My questions is, does the employer has the right to ask the employee to leave early although notice period is given?

Does the employer need to pay the balance notice period of 1 month in lieu if they decided to ask the employee to leave early. 

Appreciate advice on this.

Yes, the company can do but must pay salary for the month of short notice.

Talk to your HR first see what they say. If they don;t want to pay you may have to go to the Labour Department to make a claim for it or get a lawyer to sue for it.
