Medical Leave exceeded annual entitlement

Dear Sir / Madam,

May i check, if our staff frequently on medical leave due to common sickness like flu, sore throat, fever etc until exceeded our company's annual entitlement of 14 days. Other than deduct the exceeded days of MC from the annual leave or treat it as unpaid leave, is there any other action that the company can take based on the Employment Acts ?

Did the employer have the right to give warning letter or notice to terminate this staff due to absent on illness ? The staff was given medical cert from the clinic doctor whenever she was on medical leave.

When sick leave and annual leave entitlement exceeded, other MC will be treated as no pay leave. You don't sack employee when he has valid MC. If you have company appointed panel doctor, that will be better so that you can require them see company panel doctor when sick.
