Working hour more than 8 hours in one day

Our working hours as below:

Monday to Friday = 8.00am to 5.30pm (Working Hour) , 12.15pm to 1.00pm (Lunch Time) , 3.30pm-3.45pm (Tea Break)

Monday to Friday Actual Working Hour = 8.5 hours / day

Saturday = 8.30am to 12.15pm (Working Hour)

Saturday Actual Working Hour = 3.75hours

Even though working hour no more than 48 hours in one week, but already more than 8 hours in one day. Is this against labour law? Should we pay OT rate to worker start from 5.00pm (Monday to Friday)?

For Office staff that salary more than RM2500, under protect of employment act?

Give a call to the Labour Department and talk to one of officers there for an official ruling.

Hi, refer to foresaid inquiry. Does employee that has salary more than RM2,000 a month can be covered under Section 60A(1) EA?

Or is it only applicable to those employees categorized under First Act Schedule - Section 2(1)?

Kindly advice.
