Compulsory Leaves (Forced leaves) on selected Public Holidays

Hi there,

My Company has recently come out with a memo to all employees stating that three selected public holidays in 2019 (Wesak Day, Nuzul Al-Qur'an, Awal Muharram) will be considered as compulsory annual leaves, which means the company will not be operating on that three days and employees are to use our annual leaves on that three particular days. We all know that employer has no rights to force us to use our annual leaves on selected date; however, may I know in which section of the Malaysian Labour Law can I refer to? Besides, what is the best way to lodge a complain regarding this matter? To whom and how?

The employer should not do that and the Employment Act also has no provision for employers to do that. You can bring the matter up with the Labour Department.
