Appointment Letter Content

Date of Commencement: 03/09/2018

Monthly Salary: RM 5,000

My date of commencement of work in this new company stated in appointment letter is 03/09/2018 whereby the 1st and 2nd of September of 2018 is fall on Saturday and Sunday which are not working day.

The actual working day for September 2018 (01/09/2018 to 30/09/2018) are 20 days (4 weeks x 5 days/week) which I have been working full 20/20 working days without any absence.

But my HR Manager told me that the Management needs to pro-rated my monthly salary and make deduction of my 2 days pay for 1st and 2nd of September.

My question is does the Company has legally enforceable right to do such deduction? It is fair and just that the Company can do such deduction?

In my opinion, your Sept salary should be (5000/30) x 28. You are not yet an employee of the company on 1 and 2 September.
