Commission on Resignation

I'm resigning from current employer and in the corporate sales commission & Incentive plan have terms

* All outstanding sales commissions will be fortfeited should the employee decides to resign by the company*

* All payouts for sales commission and incentive will be upon full invoice collection.*

Problem is that the commission payout for is upon full invocie collection and they purposely delay 6 months after collection only start paying, and the company divide the amount into 6 different installment to drag the payment.

E.g. Total commission 60,000, full collection on March and they delay till September only start paying, 10,000 every month for a period of 6 months, so it is an never ending collection.

Please advise if I'm allowed to make a case with Labour Dept or should I engage a lawyer to make a claim on this?

You can give it a try to bring the matter up with the Labour Department.
