City Council Declared Leave

Here's the case:

The Majlis Perbandaran (state city council) has declared a two-days public holiday, and instructed all shops to close on the first day (mandatory), and shops that wants to operate on the second day must pay the employees allowance.

In this case, can the employer choose to operate normally on the second day, while disregarding the state city council's order to provide the staff allowance (a.k.a paying normal wage hours)?

For Hari Raya Haji. The city council declared a two-days public holiday (22/8 and 23/8), and allowed shops to operate on the second day, provided that they provided the staff with allowance.
