Hi,

I have an employee ( probationary ) who has been working for six months. She asked me whether can she resign with 24 hours notice since there is no clause stating in offer letter that she need to serve notice period before resigning , since she is still under probation. There is only clause for one month notice if she were a confirmed staff in the letter.

Can she resign with 24 hours notice since there is no clause under her offer letter?

Will she be paid fully till her notice date?

When there is clause for notice, by law, notice period for termination of service is one month. However, if you agree to let her go with 24 hours and you will not claim any compensation from her, it is OK. If you don't agree, she has to give one month notice.
