Hi,
Kindly advise this salary calculation by my company is accept by labour law? details as below:
Company count my salary like this = RM2600/22*21 (actual number of working days for that month) = RM2481.81.
And my company told me salary calculation for Saturday & Sunday will excluded. But public holidays included.
As i know the normal salary calculation for labour law is not calculate by por rate, for calculate by por rate maybe is for new join staff for 1st month or resign of month (if not work for whole full month). The salary should be calculate like = 2600 - 11% (EPF) - socso - SIP = salary, am i correct? please correct me if i'm wrong and please let me know my company count the salary like this isn't can be accept by labour law.
Thanks.
Since you are paid monthly salary of RM2600, you should get the full sum of RM2600, isn't it? Saturdays, Sundays and public holidays should also be included.
Hi,
Ya, as per you reply is what i think, in offer letter my company write my salary is RM2600 per month but calculation is by working day + PH, if that month is 21days working then i will short one day pay(due to my monthly salary), if that month is 23days then i will get one more day salary, may i know this calculation is acceptable by malaysia labour law?
2nd is my company have few department like retail department, online department and admin/finance department, my boss say due to other department saturday got work and admin/finance department no work on saturday, so company count salary by working day, may i know this also can acceptable by labour law?
