Deny Sick Leave of Employee When Not Visiting The Appointed Clinic

Hello guys,

Our company has appointed a clinic which is nearby our work place. And our staffs are all living in this area which the clinic is at a reasonable distance for them to visit. However, one of my staff continuosly took MC for a few days and the clinic he visited wasnt the appointed clinic. Do we employer have to right to deny his MC and take his absences as unpaid leave?

60F.1(b) mentioned if no such medical practitioner is appointed or, if having regard to the nature or circumstances of the illness, the services of the medical practitioner so appointed are not obtainable within a reasonable time or distance, by any other registered medical practitioner or by a medical officer, still can consider as sick leave

So you need to clarify with the employee reason to go to that non panel clinic. Is the panel clinic have no doctor/specialist for his illness or because of other reasonable cause he went to non panel clinic.

Hi Gon, thanks for your reply.

Here is the problem, we question him already but he said it is up to him to go to any clinic right? However, any other employees here know which clinic to go because we already informed them which is the appointed clinic. The clinic we appointed is very near to his house which is around 3-5mins away. However, he visited the clinic which is way further than the one we appointed, it is 20-25mins away. And both clinics are just normal GP clinic and also reachable at the same working hour.
