offer letter 里面这写的

PROBATION

You are required to serve a probation period of 3 months and we will be extend your probation period up to 6 months in the event we need more time to observe your job performance.

NOTICE PERIOD AND TERMINATION

Either party may terminate your employment by giving one month notice in writing or payment of the one month reference salary in lieu of notice during probation period. After confirmation, either party may terminate your employment by giving two months’ notice in writing or payment of the two months’ reference salary in lieu of notice. In the event that the termination is initiated by the employee, at XXX company discretion, this requirement for the notice period or payment in lieu of notice may be waived.

XXX company reserves the right to terminate your employment forthwith without notice for cause. Cause includes, among other things, dishonesty, misconduct, any violation of company policies and /or failure to perform your job satisfactorily.

如果我觉得这员工 performance 不够好, 请问我​要怎么执行termination?

据我所看到的其他topic里有说到,就是员工有权利要求probation延长到6个月对吗?

如果执行termination我是不是应该赔偿一个月的工钱?

1. Just by saying "poor performance" may not  be good enough reasons to terminate the service of a worker. Employer must give guidance, training first. If after adequate training there is not improvement then the employer may think of terminating his service.

2. Extension of probation is given by the employer if he thinks necessary and not at the request of the worker.

if the training had been provided, still not pass the training. i may direct proceed with terminate letter?

what about if had 3 month? can the company proceed direct termination ?

Then you may have to terminate his service based on the terms of his contract of service.
