Resignation & Leave Issue

Dear officer,

Good afternoon.

We have an employee from our Penang Branch Office who have tendered his resignation.

Based on accumulative leave, he have a total of 130 days as he have worked with us for 10 years, and rarely take his leave.

However, company policy only allows a total of 5 days to be bring over from the previous year to the following year.

He currently would like to resign, and take the 130days leaves which would require us to make salary payment to him till Aug 2018.

Please advise on what would be the correct procedure to follow.

why you have accumulate leave up to 130 days?

if you only allow carry forward 5 day, how he can accumulate 130 day? 5 carry forward is new policy?

Company usually do it as a goodwill for accumulative leave. That’s why got 130.

Indicated in appointment letter is 5 days carry forward

Then it may be fair to pay him at (salary/26) x 130.

Dear officer 

   Is there any labour law state that if we take any emergency leave , the company need to deduct 3 days of our salary? And i have work with the company for 9 month only and already get increment salary do i need to give 2 month notice or 1 month ?
