Non confirmation during probation period

At first Staff A worked with Company M. However, Company M take over by one of the director Company M and name change to Company J.

Staff A resigned from Company M on 1 October 2017 (serve 1 months' notice) and joined Company J. on 1 November 2017. New offer with same position and wages with 3 month's probation period and probation will be end on 31 January 2018. However we found that his working attitude very poor recently:

1) lazy

2) not follow manager instruction

3) absent without notice (warning letter issue for absenteeism) 

First Performance Appraisal done on 31 December 2017 and inform him show improvement to us before end of the probation period. But he still not work well. We are planning to issue non confirmation letter ask him to left 24 hours with paid 1 month salary in lieu + Jan salary.

Please advice am i do the right decision and right way?

Looks like he has a list of misconduct.  If you have sufficient evidence, you can conduct a domestic inquiry and then decide what sort of penalty to mete out. Do not dismiss him summarily without giving him a chance to have his say.

you need to build up the case since have list of misconduct and no improvement was shown.

You need list down when he is found lazy (date + time + what is expected to do and what he had done + average time other staff need to complete the task) + (insubordination = date + time + what is instruction and what he had done) etc etc

Then initial domestic inquiry procedure, give him chance to defend himself.

Cannot simply terminate him and pay him.

I'm did not done domestic inquiry. First performance appraisal 30/12/2017 did mentioned his absent & no follow instruction. But during this week he still no improve do the same mistake. Yesterday he agreed leave in 24 hours. we just issue non confirm letter & pay him salary & one month salary in lieu. So how?
