Profit Sharing or Incentive ?

Does Profit Sharing applies only to full time "employee and contract staff"?

Is it common for a freelance contract representative bind under Contract For Service to enjoy Profit Sharing as well or should i just put it under the term "Incentive or Commission" for the work he has done?

In order to make sure, you really have to bring the contract to the Labour Department, EPF and SOCSO for them to decide whether there is any employer employee relationship or not. They may want to go through the terms and conditions of the contract to make a decision.

When it is refer to contract for service = you are independent contractor and not an employee.

To enjoy or not enjoy the profit sharing is the mutual agreement between two parties.

When you put in the contract, regardless you as employee or independent contractor, both will enjoy the benefit
