If between company & staff already have a mutual agreement that NO deduction applies to Commission collected but other benefits (medical, annual leave etc) are standard so can company offer this staff under CONTRACT OF SERVICE with an exclusion clause (your commission shall not be entitled to any statutory deduction), will this contract considered null and void or it's fine with the exclusion clause included?

Thank you.

I don't think EPF will allow that. Give a call to EPF and consult the officer there and get an official ruling.

Thank you Siew for your prompt reply, much appreciated!

Just checking if company were to hand out another stand alone letter/ agreement separately and get staff to sign pertaining to the mutual agreement that commission wont be liable to EPF deduction, will that be ok?

Thank you again.

As far as I know, such mutual agreement is not valid. As I said, get official ruling from the EPF.
