员工做超过五年的病假天数

依据劳工法令,做满五年或以上的员工都有二十二天的病假。我们公司的政策是不管做了几年的员工,他们的病假都是十四天,而他们所签的雇用合约上也有说明了他们的病假是十四天,那么当员工拿了超过十四天的病假后,他再给公司病假单时,公司却算他无薪假期,公司算是触犯劳工法令吗?请问员工可以去劳工部告公司吗?

Yes, you should go and make a complaint at the Labour Department.

If the worker's salary exceed RM2000, is he cover by employment act? Can he make a complaint at labour department?

If he is a manual worker, he can. If he is not a manual worker, he cannot as far as sick leave is concerned. Refer to the First Schedule of the EA.

If he is a QC inspector, welder or painter? Is he a manual worker?

If he work as office staff, is he a manual worker?

He is then not a manual worker. In that case, he is definitely getting a bad deal by getting less benefits than those whose salary is less than 2K, who are covered by the EA. Sorry for him.
