Dear Mr. Siew,

An executive has given the instruction to HRA to confirm a supervisor under probation with a demoted position of an assistant supervisor.  The reason stated is the said staff is not qualified to be a supervisor but can be trained to be one. How can a person is employed as a supervisor but confirmed as an assistant supervisor; this is definitely a demotion and not right.

If he is not satisfied with the staff's performance, he could have just extended his probation period for another 3 months although the staff has undergone a 9 months probation. Please advise.

I think you just cannot take the words of the executive. You have to investigate and consult  the staff concerned. If you do that without proper consultation, it can be a breach of the contract of service. If you think his performance is not up to the mark, give training or extend his probation period. As far as the staff concerned, if he is not satisfied with the demotion, he can bring the matter up with the Labour Department.
