Resignation (Deduct Annual Leave)

One of the staff tendered resignation on 3 July and he has to serve 3 months notice, last day is on 2 October. He has 9 days leave balance, and HR agreed to deduct his leave balance. So, his last day will be on 18 September. 

HR need to pay until 2 October or 18 September?

Dear Admin,

I have the same scenario as above​, last day for 3 months notice supposed to be 23/11/17 but after offsetting unutilised AL last day will be 6/10/17. My understanding is the HR needs to pay up to 23/11/17 even though the staff only work until 6/10/17, correct me if i'm wrong. 

if this is the case, could you please quote me the Employment Act's paragraph for the above scenario ? And would this also cover for non-manual staff for salary RM 5,000 ?
