Termination during probation period

Good afternoon. I would like to know if an employee is still under probation, and has been issued 2 warning letters due to poor attendance, can the company terminate this person after a third warning issued due to a different reason? Should a Domestic Inquiry still be conducted?

If the employee is terminated, are we allowed to dismiss him without pay with proper reasoning as to why he was not entitled to the pay, like serious misconduct?

If the employer thinks the misconduct has been committed a domestic inquiry should preferably be carried out first before meting out punishment. Refer to section 14 of the EA for guidance.
