Deduction for Unpaid Leave in Wages

Dear Sirs,

Question 1 :

An employee (wage below RM2,000) has applied 2 days unpaid leave (approved by his Superior) on 30/8 and 2/9 coupled in with 31/8 National day, 01/9 Hari Qurban and 03/9 Rest day to go back hometown.   Total number of days away is 5 days -  30/8, 31/8, 1/9, 2/9 and 3/9.

Does this employee qualify for the holiday pay (31/8 and 01/9) and rest day pay (03/9) ?

Question 2

An employee is schedule for night shift work 8:00pm to  8:00am and the factory announce 1 day shut down for maintenance from 6:00pm to 6:am.

Should this employee be paid for the 1 day factory shut down ?

1. Only deduct 2 days unpaid leave as the unpaid leave was approved.

2. Should be paid for the day.

If you need some official ruling, contact the Labour Department.
