Resignatin Notice Period

Hi MY Labour Law,

We have 1 employee tendered his resignation on 01 Aug 2017 and put the effective resignation date on 04 Sept 2017.

Based on our company policy, the notice period is 1 month as per below :-

Notice Of Termination : Either party has to give ONE MONTH written notice or pay the equivalent salary in lieu of such notice to terminate the contract of employment.

To us, the last date shall be 31 August 2017 (Thursday). The last date beyond 31 August 2017 will be at our management discretion.

The employee argue with us that we should pay him until 03 September 2017 instead of 31 August 2017.

01 September 2017 (Friday) = Public Holiday, 02 September 2017 (Saturday) & 03 September 2017 (Sunday).

Please kindly give your advise.

One month notice should be from 1/8/2017 to 31/8/2017

Thanks for your replied.

Meaning to say if we didn't pay for 01, 02 & 03 September, there is no violate to employment act, right?
