Dear Admin,
I would like to find out what my entitlement is in terms of leave days left with the following work arrangement:
Started work in May 2014. Resigned 16 June 2017.
There is no contract, no appointment letter prior or upon commencement.
Expected to get an MC, but there is no medical provided.
Even though there was no contract, after they've asked, I've agreed to stay for 2 months to serve my notice so that I am able to train the next person up. No one was hired to replace me. My last day is 16 August 2017.
My annual leave days for the first 3 years was 14 days, and increased to 21 days on my fourth year i.e. 2017.
Admin person in the office is now saying that he has to prorate my remaining leave days. I could have left the organisation much earlier, but I didn't.
I have taken 4 days of annual leave this year.
I have 9 days of replacement leaves left.
Please advise.

As your last working day is 16 Aug 2017, it means you have put in 7 1/2 months of service for 2017. Based on your leave entitlement of 21 days, your earned leave for 2017 = 21/12 x 7.5 = 13.125 days or round-down to 13 days.
