Resignation without Contact and Leave Days Left

Dear Admin,

I would like to find out what my entitlement is in terms of leave days left with the following work arrangement:

  • Started work in May 2014. Resigned 16 June 2017.
  • There is no contract, no appointment letter prior or upon commencement.
  • Expected to get an MC, but there is no medical provided.
  • Even though there was no contract, after they've asked, I've agreed to stay for 2 months to serve my notice so that I am able to train the next person up. No one was hired to replace me. My last day is 16 August 2017.
  • My annual leave days for the first 3 years was 14 days, and increased to 21 days on my fourth year i.e. 2017.
  • Admin person in the office is now saying that he has to prorate my remaining leave days. I could have left the organisation much earlier, but I didn't. 
  • I have taken 4 days of annual leave this year.
  • I have 9 days of replacement leaves left. 

Please advise.

As your last working day is 16 Aug 2017, it means you have put in 7 1/2 months of service for 2017. Based on your leave entitlement of 21 days, your earned leave for 2017 = 21/12 x 7.5 = 13.125 days or round-down to 13 days.
