Hi There,

I have been bonded for 5 years for a staff loan agreement ( this includes the salary and the tuition fee they have paid (rm7000/rm10000 ie  70% of it) .

I have been on full salary  rm 3000 but executed 1/2 monthly work.  ( for eg i earn rm3000 and i do work for half month and i was paid rm 3000 per month for 4 years)  However the contract i have signed shows that I am liable to rm3000 x 48 months (4 years) in that they did not take into account that i have worked for rm1500 ( half month) /3000.

Also they have put both the agreement together and imposed a 5 year bond on me or i will have to pay back the rm3000x 48 month plus rm7000 for my tuition fees.

My query is should they not only impose rm1500 x 48 months and the tuition fee (rm7000)  and  Is this considered reasonable under s 75 CA 1950 on liquidated damages ?

They have also not given me any salary review for my qualification ( which they had customarily practised in the past years for all those who attained the qualifications).  This is not written anywhere as a contract between the company and I.

thank you

I think you need a lawyer to give you legal advice.
